Rules

GENERAL PROVISIONS

1.1. This Agreement establishes the specific features of providing exchange services by the Online Service.
1.2. The Online Service refers to the internet resource for exchanging virtual money – tocoex.com
1.3. Users include individuals and organizations who have agreed to cooperate with the Online Service.
1.4. In general references, the User and the Online Resource are referred to as the Parties.
1.5. The Parties agree that this electronic Agreement has the same legal force as a written contract and is intended to regulate their relationship in the process of consuming exchange services.
1.6. The Agreement is considered a public offer, the acceptance of which occurs through the User's submission of an application to receive services provided by the Online Service. The application is submitted through the web resource tocoex.com



SUBJECT OF THE AGREEMENT

2.1. The subject of this Agreement is the Services provided by the Service, the description of which is given on the Service's website.
2.2. The Service offers its services to all Users and does not verify the Users' authority to manage these funds and does not supervise the User's operations in any Payment System.
2.3. Payment systems and/or financial institutions bear exclusive responsibility for the funds entrusted to them by the User. The Service cannot be a party to an agreement between a Payment System and/or financial institution and the User and in no way bears responsibility for the improper or unauthorized use of the Payment System's capabilities by the User, as well as for the User's abuse of the Payment System's functionality. The mutual rights and obligations of the User and the Payment System and/or financial institution are regulated by the respective agreements.



RIGHTS AND OBLIGATIONS OF THE PARTIES

RIGHTS AND OBLIGATIONS OF THE PARTIES

3.1. The Service has the right to suspend or cancel an ongoing transaction if information from law enforcement agencies or Payment System administrations is received regarding the User's unlawful possession of funds and/or other information that makes it impossible for the Service to provide services to the User.
3.2. The Service has the right to transfer information about the electronic currency transfer to law enforcement agencies, the administration of Payment Systems, as well as victims of unlawful actions who have suffered as a result of proven fraud.
3.3. The Service has the right to suspend and cancel an ongoing transaction if the User violates the terms of this Agreement.
3.4. The Service has the right to cancel an ongoing transaction and return the User's deposited funds without explanation.
3.5. The User has the right to request the cancellation of an exchange and the return of funds only in situations where the automatic execution of the exchange operation becomes impossible. The return of funds is carried out within 24 hours and only to the details from which the User sent the funds.
3.6. When making a refund, a commission is withheld to compensate for the Service's expenses. In some cases, additional fees of up to 10% of the amount may apply.
3.7. In case of a refund to the User for any reason, if the Service's expenses exceed the refund amount, the Service has the right to refuse the refund.
3.8. In the event of a refund, if the User does not respond to the Service's requests within 12 hours, in some cases, the refund may be made in an amount equivalent to the value of the assets sent in USDT at the time they were received by the Service.
3.9. By making an exchange, the User confirms that they agree with these Rules and accept the terms of the Agreement, the User is at least 18 years old, the laws of their country of residence do not prohibit the use of this Service, and the User does not plan to engage in any illegal activities using the Service.
3.10. By accepting the terms of this Agreement, the User guarantees that they are the lawful owner of the funds and/or cryptocurrency.
3.11. By accepting this User Agreement, the User confirms that they understand the principles of the Service and take full responsibility for all risks and losses associated with using the Service.
3.12. The Service has the right to refuse the User's application processing without specifying a reason.
3.13. The Service has the right to unilaterally change this agreement. However, this does not relieve the Service of its obligation to post the current version of the agreement on the website tocoex.com.



EXCHANGE OPERATIONS

4.1. Questions and claims regarding applications are accepted within 24 hours from the moment of submission. After 24 hours, exchange applications are considered duly executed or unpaid, depending on their status at the time of the specified period.
4.2. The Service does not fix the rate at the time of application creation but recalculates it after the transaction receives the necessary number of confirmations or funds are received in the Service's account.
4.3. Applications requiring operator participation are processed during the operator's working hours (10:00 AM – 12:00 AM MSK).
4.4. The User cannot cancel an application after sending funds to the Service.
4.5. The Service does not support receiving and sending funds through smart contracts.
4.6. The regulation for sending funds to Visa, MasterCard, MIR cards, and Qiwi accounts ranges from a few seconds to 5 working days. In practice, 99% of transfers are sent within 60 minutes, in rare cases — up to 12 hours. If necessary, the exchange operation can be executed in several transactions within specially agreed terms by the Service and the User.
4.7. In applications where the User is to receive rubles, the amount received is rounded down to the nearest whole number (without kopecks).
4.8. Before performing exchange operations, the User must independently ensure the correctness of the network selection. Transactions made on a network other than the one specified in the application may become irreversible, and the funds will be lost. The User bears full responsibility for choosing the correct network when sending or receiving funds!
4.9. Each exchange application has a limited time for payment: 55 minutes for cryptocurrency and 30 minutes for rubles. This period is displayed with a timer on the application creation page. Payments made after the timer expires may be subject to processing delays.
4.10. The User creating an application must be the owner of the payment method (e.g., bank card) used to pay for the application. Violation of this rule may result in the exchange being suspended and a request for supporting documents.
